Sodomy | Penal Code § 286

Description

Sodomy is sexual conduct consisting of contact between the penis of one person and the anus of another person. Any sexual penetration, however slight, is sufficient to complete the crime of sodomy. A person who participates in a an act of sodomy with another person under 18 years of age would be charged with a felony.

What does the prosecutor have to prove?

1. Defendant participated in an act of sodomy with Victim.
2. The Victim was under 18 years of age.
