A felon may be required to provide a DNA sample under the following circumstances:
- The felon is an adult and is arrested for a felony offense,
- The felon is convicted of, or pleads guilty to, a felony offense,
- The felon is housed in a mental health facility or sex offender treatment program after referral by a court after the felon was charged with any felony offense,
- The felon is required to register under Penal Code section 290 (sex offenses) or Penal Code 457.1 (arson) due to commission or attempted commission of a felony or misdemeanor offense.
