Methamphetamine (Possession for Sale) | H&S Code § 11378

Description

The possession of controlled substances, including Methamphetamine (Possession), is prohibited. Possession of a controlled substance, Methamphetamine (Possession for Sale), with intention to sell is more serious. The California Health and Safety Codes include additional punishments and rehabilitation options. Controlled substances also include stimulants, “party drugs”, and illegal steroids.

What does the prosecutor have to prove?

1. Defendant exercised control over, or purchased from another a controlled substance;
2. Defendant knew of its presence;
3. Defendant knew of its nature as a controlled substance;
4. The substance was in a usable quantity sufficient to be used for sale or consumption;
5. Defendant possessed or purchased the controlled substance with the specific intent to sell same. [Cal Crim No. 2302]
