Description
A person who either resides in the same home with the minor child or has recurring access to the child, who over a period of time, not less than three months in duration, engages in three or more acts of substantial sexual conduct with a child under the age of 14 years of age at the time of the commission of the offense may be charged with Continuous Sexual Abuse of a Child.
What does the prosecutor have to prove?
1. Defendant was a resident with the minor or had recurring access to the minor; and
2. Defendant over a period of not less than 3 months engaged in 3 or more acts of substantial sexual conduct, or 3 or more acts of lewd or lascivious conduct, with the victim who was under the age of 14 years at the time.
Punishment
Felony: 6years/12years/16years
With probation 0-364 days
