Sex Offender Registry San Diego Legal Information

If you are convicted of a sex crime in California you may have to register as a sex offender. “Registering” refers to the process of keeping your local law enforcement agency informed about your general whereabouts. Depending on the crime charged, a defendant may have to register for 10 or 20 years depending on the tier they fall into under the Sex Offender Registration Act. The Sex Offender Registration Act, also known as Penal Code section 290, created a three-tiered sex registration system:

  • Tier one – Registration as a sex offender for at least 10 years
    • For lower level offenses including misdemeanor sexual battery or indecent exposure
  • Tier two – Registration is a sex offender for at least 20 years
    • For mid-level sex offenses including lewdness with a minor under 14, and non-forced sodomy with a minor under 14 years old
  • Tier three – Registration as a sex offender for life
    • For most serious sex offenses such as rape, lewdness with a minor by force or fear, sex trafficking children, sex crimes against children 10 and younger, and repeated sex crimes

Any person who, since July 1, 1944, has been or is hereafter convicted of the following Penal Code sections shall register as a sex offender:

  • 187 committed in the perpetration, or an attempt to perpetrate, rape or any act punishable under Section 286, 288, 288a, or 289;
  • 207 or 209 committed with intent to violate Section 261, 286, 288, 288a, or 289
  • 220, except assault to commit mayhem
  • 243.4
  • 261(a)(1), (2), (3), (4), or (6)
  • 262(a)(1) involving the use of force or violence for which the person is sentence to the state prison
  • 264.1
  • 266
  • 266c
  • 266h(b)
  • 266i(b)
  • 266j
  • 267
  • 269
  • 285
  • 286
  • 288
  • 288a
  • 288.3
  • 288.4
  • 288.5
  • 288.7
  • 289
  • 311.1
  • 311.2(b), (c), or (d)
  • 311.3
  • 311.4
  • 311.10

  • 272, involving lewd or lascivious conduct
  • 288.2, any felony violation
  • Any person who since that date has been or is hereafter convicted of the attempt or conspiracy to commit any of the above-mentioned offenses
