Client was charged with felony assault under Penal Code section 245(a)(4) with a great bodily injury enhancement under section 12022.7(a). He was facing a strike offense and up to seven years in prison. Despite serious injuries and damaging surveillance video, we negotiated a resolution with no jail time. The strike was dismissed, the case was later reduced to a misdemeanor, and ultimately expunged.

The allegations involved a group assault resulting in complex facial fractures and a subdural hemorrhage. Surveillance video captured part of the altercation, and civilian witnesses described significant force. The prosecution pursued a serious felony with sentencing enhancements that carried long-term consequences and a strike under California’s Three Strikes law.

We prepared the case for litigation and developed a mitigation profile that included client background, work history, and evidence of rehabilitation. Despite the severity of the injuries and video evidence, we successfully avoided both prison and any custody time.

The felony was dismissed. The case resolved as a misdemeanor. The conviction was later expunged, leaving the client with no criminal record.
