Our client faced multiple serious felony charges that carried over twenty years in prison and lifetime sex offender registration. The case involved four separate alleged victims and included charges of oral copulation of a minor, unlawful sexual intercourse, forcible oral copulation, forcible rape, robbery, and grand theft. After a full day of cross-examining the primary alleged victim at the preliminary hearing, her story fell apart under questioning. In the middle of the hearing, the judge suggested that the prosecution dismiss the rape charge, and it was dismissed on the spot.

The original charges were: PC 287(c)(1) – Oral Copulation of a Person Under 18 (2 counts); PC 261.5(c) – Unlawful Sexual Intercourse with a Minor (2 counts); PC 287(c)(2)(C) – Forcible Oral Copulation; PC 261(a)(2) – Forcible Rape; PC 211 – Robbery; PC 487(a) – Grand Theft of Personal Property (2 counts).

We conducted a meticulous investigation before the preliminary hearing, reviewing police reports, forensic evidence, and witness statements. Our team uncovered multiple inconsistencies in the alleged victim’s statements that undermined her credibility. During cross-examination, we highlighted these contradictions and demonstrated that her testimony could not withstand scrutiny.

The dismissal of the rape charge at the preliminary hearing was a critical victory, eliminating the most serious allegation and the potential for lifetime registration. It turned a case with life-altering consequences into a winnable outcome and protected our client from the most devastating charges.
