Our client was charged with domestic violence (Penal Code § 273.5) and three counts of misdemeanor child endangerment (Penal Code § 273a(b)). Despite damaging witness claims and emotional child testimony, we cross-examined every key witness, exposed manipulated evidence, filed mid-trial motions, and secured a complete dismissal of all charges.
The case arose from an argument between husband and wife after a Super Bowl party. After a heated exchange, the husband took their three young children home and locked the wife out of the house. She later kicked in the front door and attempted to force her way inside. A brief physical struggle followed. The children were home and awake. Neighbors called police, reporting threats they claimed to have overheard.
When police arrived, the wife explained that her husband had not assaulted her. That did not stop the arrest. Officers entered the home and told the children their father had hurt their mother and was being taken to jail.
Despite the wife’s statements, prosecutors filed one count of domestic violence under Penal Code § 273.5 and three counts of child endangerment under Penal Code § 273a(b). They then subpoenaed the couple’s young children, including their four-year-old, to testify.
At trial, we cross-examined the civilian witnesses and exposed critical weaknesses in the prosecution’s case. We filed a mid-trial motion under Penal Code § 1118 to dismiss the child endangerment charges. The court granted it.
We then uncovered that the prosecution had withheld recent photographs taken by both sides showing that the neighbors could not have seen the front door. Instead, the prosecutor attempted to introduce outdated Google Earth images from 2019 with a clear line of sight. Under cross-examination, the witness admitted the images were inaccurate. We objected, and the court sustained the objection.
We immediately filed a written motion laying out the misconduct and requested dismissal under Penal Code § 1385. The court granted our motion. With the jury waiting in the hallway, all remaining charges were dismissed.
