DNA Sample

A felon may be required to provide a DNA sample under the following circumstances:

1. The felon is an adult and is arrested for a felony offense,
2. The felon is convicted of, or pleads guilty to, a felony offense,
3. The felon is housed in a mental health facility or sex offender treatment program after referral by a court after the felon was charged with any felony offense,
4. The felon is required to register under Penal Code section 290 (sex offenses) or Penal Code 457.1 (arson) due to commission or attempted commission of a felony or misdemeanor offense.
